  • Effective January 1, 2003, the statute of limitations in California (the time in which to file a lawsuit) for personal injuries or wrongful death was changed from one year to two years from the date of the injury.

  • Despite the California statute of limitations, if you are injured as a result of conduct of a California public entity or an employee of a California public entity, you must file a written claim with the appropriate agency within 6 months of the date of the accident. If your claim is not responded to, or if it is expressly denied, you then have an additional limited amount of time to file a lawsuit, regardless of the recently revised statute of limitations. If you believe you might have been injured as a result of conduct of a public entity or an employee of a public entity (e.g. accident involving an MTA bus), you should immediately contact an attorney in order to adequately protect your rights.
